3AC Liquidators Issue Subpoenas for Su Zhu and Kyle Davies on Twitter

The subpoena details demand information about investor accounts, Three Arrow Capital's trading activity in crypto derivatives, etc.

3AC Liquidators Issue Subpoenas for Su Zhu and Kyle Davies on Twitte

The liquidators of the bankrupt hedge fund Three Arrows Capital (3AC) delivered subpoenas to the fund’s founders Su Zhu and Kyle Davies via Twitter.

As a U.S. citizen, Davies was handed the subpoena by the Southern District of New York Bankruptcy Court, whereas both co-founders were handed the order by Singaporean courts.

Davies and Zhu are not the first in history to receive subpoenas via Twitter. Due to claims of conspiracy with Russia, Wikileaks was given a subpoena on Twitter in August 2018 by Cohen Milstein, a law firm that defends the DNC.

The company that released both of the documents attested to their validity and stated that an email with an unredacted copy had also been sent.

The subpoena details demand information about investor accounts, Three Arrows’ trading activity in crypto derivatives, and a slew of the technical details pertaining to the firm’s crypto wallets that supported its trading. 

The 3AC liquidators request documents detailing the firm’s dealings, including investments and engagements with its partners and counterparties including service providers.

The information is requested in a variety of formats, including any digital communications, internal spreadsheets, accounting information, executive calendars from Three Arrows, and information from the company’s network access and server activity logs, etc.

The subpoena requests that Zhu and Davies “state the date and type of the document and explain why the document is unavailable” if the requested materials are no longer in their possession, custody, or control.

Following the demise of FTX, Davies and Zhu have been utilizing Twitter more often. In the midst of the turmoil surrounding Genesis’s liquidity issues with Gemini, they have been outspoken detractors of Genesis and Digital Currency Group (DCG).
