West Virginia introduced House Bill 5461, known as the Financial Accountability Stable Token Act (FAST Act), on Thursday at the state capitol in Charleston. The legislation would allow the voluntary use of qualifying stablecoins for payments to state vendors and contractors.

According to the official filing, the bill is intended to modernize financial operations and potentially reduce transaction costs. It constitutes an effort to integrate blockchain-based digital assets into the treasury management of a U.S. state government. The bill has been referred to the Committee on the Judiciary.

Oversight and voluntary participation

The FAST Act sets up a structure for the state treasurer to manage the use of these digital assets. Under the proposal, the treasurer would keep a list of authorized tokens and ensure they meet strict safety standards. 

Participation for state vendors and contractors would be completely voluntary. No private entity will be forced to accept digital assets instead of traditional currency while confirming that such payments satisfy state obligations. 

Token eligibility criteria 

To qualify under the FAST Act, a stablecoin must meet specific regulatory and financial criteria. The bill describes a qualifying stable token as an asset that is issued by a corporation located in the United States, with American citizens as founders and primary shareholders. 

The qualifying stable token is then backed on a one-to-one ratio by U.S. dollars or short-term Treasury obligations. Additionally, the legislation prohibits tokens backed by commodities, synthetic assets, or foreign currencies.

Reserve and audit mandates

Issuers would need to keep reserves in U.S.-chartered banks and submit to quarterly independent audits by a firm registered with the Public Company Accounting Oversight Board (PCAOB).

The legislative effort comes as part of a growing national conversation about regulating digital assets. The bill specifically mentions the federal Guiding and Establishing National Innovation for U.S. Stablecoins (GENIUS) Act of 2025, indicating that West Virginia aims to align its laws with new federal frameworks.

Historically, state governments have been wary of cryptocurrency due to its volatility. However, by focusing solely on dollar-linked stablecoins with domestic oversight, West Virginia lawmakers hope to reduce risk while leveraging the benefits of digital ledger technology.

Potential impact 

If approved, the State Treasurer would create rules for security, custody, and fraud prevention, possibly serving as a model for other states. The bill also requires an annual public report on transaction volumes and cost savings, providing real data on whether digital assets truly enhance government efficiency. 

If the program shows considerable cost reduction, it may encourage broader use of stablecoins for other kinds of public payments beyond vendor transactions.

By emphasizing transparency by publishing monthly reports from public reserves and restricting it only to U.S.-based entities, the FAST Act seems to encourage a balance between technological upheaval and fiscal caution.
